📣 The Consultation Is Open

Today, the Government officially launched its consultation on the regulations underpinning the new NDA reforms in the Employment Rights Act. This is the stage where the law gets its teeth, or doesn’t. The consultation is open for 12 weeks, closing on 8th July, and it’s vital that as many people as possible respond.

The details being decided right now include:

• The conditions an excepted NDA must meet to still be valid, when requested by the employee

• Who workers should always be free to speak to, regardless of what they’ve signed

• Whether protections extend to freelancers, agency workers and the self-employed

That last point is especially critical, as so many people in the UK work on a freelance, self employed or project basis and currently fall outside the full scope of employee protections. Coercive confidentiality thrives in that gap, and this consultation is the opportunity to close it for good.

As Zelda said in today’s Government press release: “This is the chance to create world-leading protections and finally stop the misuse of confidentiality agreements to hide wrongdoing.”

INCREDIBLE NEWS - Just days before the Christmas recess, the Employment Rights Bill, with a clause ending the misuse of NDAs, received Royal Assent - an early and extraordinary Christmas present. For the campaign, it means the final piece of the jigsaw puzzle of legislative change is now reaching completion. 🎉🎁

Eight years ago, Zelda stepped forward with one clear goal: to change legislation so that no one should ever be legally forced into silence when speaking up about harm. As we approach the end of 2025, we’re doing so with real, grounded optimism that our job is almost done.

Since the amendment to the ER Bill was tabled in the summer, our public facing work has moved more behind the scenes. 2026 begins with the final phase: consultation, implementation and ensuring these protections work as intended in practice.

The UK Has Taken a Historic Step Ending Abusive NDAs

• The Employment Rights Bill - the Big One 🎉
  What began as a cross-party push in early 2025 has now become one of the strongest legal interventions on NDAs anywhere in the world.

  In July, following sustained and coordinated pressure, the Government tabled its own NDA amendment in the House of Lords - now Section 202A. The amendment ensures that:
  

  ✅ NO form of confidentiality clause can be used to silence victims OR witnesses of harassment or discrimination.

  ✅ Protections extend beyond formal employment contracts, covering anyone who is providing an agreed service - e.g. freelance or self employed workers, volunteers etc.
  
  After passing with full support in The Lords in July and The Commons in September, the Bill completed its final parliamentary stages, receiving Royal Assent on 18th December.

  Highlights of the amendment’s journey:

  Baroness Jones of Whitchurch formally tabling the amendment and thanking the campaign in the Lords earlier this year - the moment this protection entered the Bill and began its journey into statute:

  In September Louise Haigh MP invited us into the Commons Chamber as the amendment was accepted by MPs - a surreal and emotional moment, and a milestone few believed possible when this work began eight years ago.

  The Minister for Business and Trade, Peter Kyle, addressed the new NDA legislation and the hard work it has taken to get there:

  These other pieces of legislation, which we have worked hard to implement, now complete the picture in providing protection to all:

• Higher Education (Freedom of Speech) Act - Higher education protections live

  After leading the the government to legislative change with our own pledge for Universities to sign agreeing not to use NDAs, the Higher Education (Freedom of Speech) Act came into force on August 1st 2025. Banning NDAs in cases of sexual misconduct, discrimination and bullying across English universities.

  It marked a historic milestone: the first sector-wide NDA ban in the UK.

  More importantly, it set precedent for everything that followed.

• Victim and Prisoners Act - No more NDAs to hide crime

  On October 1st, Section 17 of the Victims and Prisoners Act went live.

  This means NDAs can no longer silence victims or direct witnesses of criminal behaviour, including harassment, assault or discrimination.

  People now have a legally guaranteed right to speak to doctors, lawyers, regulators, support services, and family members.

  We worked with the Ministry of Justice on the accompanying guidance, which is acting as a placeholder while an even stronger bill is being passed through Parliament…

• Victim and Courts Bill - Stronger protections on the way

  In late October, the Government tabled strong improvements to the Victims and Prisoners Act. The Victims and Courts Bill will introduce much stronger protections than those currently in place. Section 17 is acting as a temporary safeguard, while the new Bill would make any NDA attempting to silence victims or witnesses of criminal behaviour void, for any purpose and with no restrictions - allowing a victim to speak to ANYONE including the media. It’s a major step forward, aligning with what we’ve been calling for. Read more about it here.

• July – Lift Our Voices #MeToo 2.0 International Webinar

  Zelda joined forces with our American ally Gretchen Carlson at Lift Our Voices to lead an International webinar about the #MeToo movement, discussing how contrary to accusations of it having ended, it has been steadily growing into major international law changes, workplace environments transforming and survivor-led lawsuits creating cultural change.

• October – Index on Censorship Anti-SLAPPs Parliamentary Event

  We attended the launch of From Survivor to Defendant examining SLAPPs hosted by Baroness Helena Kennedy KC and Jennifer Robinson. SLAPPs (Strategic Lawsuits Against Public Participation) remain one of the most aggressive forms of silencing. They are, in many ways, the darker cousin of the NDA and are commonly deployed against survivors of gender-based violence.

• November – Stop Hurt at Work - United Against Bullying Conference

  Zelda joined a great speaker lineup during anti bullying week to speak about NDAs, the impacts and different types of silencing and the fight for safer workplaces with the hope of gaining a statutory definition of bullying.

• The University of Galway Sheehy-Skeffington Annual Distinguished Lecture
  Zelda spoke to the University of Galway, her keynote conversation with Professor Kate Kenny explored the misuse of NDAs, the right to speak out, and the human cost of enforced silence. She also took part in an international workshop co-hosted by the University and Transparency International on gender and intersectionality in whistleblowing. This brought together researchers and advocates from across the Globe to examine how we build systems that genuinely protect those who speak up.

• December - ALL IN: Global Leaders for Ending Gender-Based Violence
  Zelda attended the launch of ALL IN: Global Leaders for Ending Gender-Based Violence at the Design Museum in London. The event brought together survivor advocates, policymakers and global leaders to focus on preventing violence against women and girls at scale, and on the leadership and sustained investment needed to turn commitments into lasting change. Member speakers included #MeToo founder Tarana Burke and Professor Charlotte Bunch among many others.

  

Four Years of CBMS UK 🎂

It’s hard to believe, but this autumn the campaign turned four years old!

What an amazing time it has been. After four years of speaking up alone, the power and determination of all those who joined Zelda and jumped aboard Can’t Buy My Silence since has been extraordinary. The bravery of victims and the help of incredible allies and volunteers ensured CBMS grew into a global movement that has shifted laws, institutions and culture in just FOUR years. This really is unusually fast and is absolutely at the feet of all of you who got us here - Thank You 👏

We Need Your Help ✊

While Section 202A is now law, its real strength will be determined by what happens next and you can shape that.

Early next year the Government will move into a 12 week consultation period. This will decide how the law is applied in workplaces; what is permitted under “excepted” confidentiality, and what victims and workers must be guaranteed in practice.

If this has any impact on you, YOUR INPUT IS VITAL. The Government wants to make sure the right safeguards are built into the regulations. Without your input the spirit of the amendment could be weakened quietly, without headlines or parliamentary votes.

The protections we need to secure through consultation include:

• Confidentiality only at the request of the employee or victim - never the employer.

• Independent legal advice, paid for by the employer, so no one signs an agreement they don’t understand.

• Plain-English contracts, ensuring fairness, clarity and accessibility for all workers.

• Time-limited confidentiality or a clear opt-out, preventing lifelong silence being imposed by default.

As the year draws to a close, we can finally say that real lasting legislative and cultural change has and is happening.

Amending the Employment Rights Bill to stop the misuse of NDAs, combined with the other pieces of legislation, marks our goal and means we can start to draw an end to this iteration of the campaign. Zelda’s broken NDA in 2017 has at last been translated into a legal and cultural shift that will change how power, secrecy and accountability operate across the UK.

This moment belongs to so many people. MPs who championed our cause throughout huge government turbulence. Survivors who trusted us with their stories. Workers who spoke up when it wasn’t safe or easy. Donors and supporters who sustained the campaign when progress felt slow. Allies who wrote to their Universities. MPs, employers or challenged institutions to keep up pressure when it mattered.

This year 2026 will start with huge possibility and positivity.

📣 Abusive NDAs are set to be banned in the UK! 📣

Last week, following a meeting with the Employment Rights Minister Justin Madders, Louise Haigh MP, Sarah Russell MP, and Baroness O’Grady, the Government tabled its own NDA amendment in the House of Lords to the Employment Rights Bill, which lays out world leading protections for workers who not only experience harassment or discrimination, but witness it.

This bill will make confidentiality clauses that attempt to silence someone who has experienced, or even witnessed, harassment or discrimination legally void. Crucially, this will apply to traditional employees, freelancers, interns, and anyone providing a service who may not have a formal contract. However, it will still allow victims to ask for confidentiality if they would like it. This is vital in terms of redressing the power imbalance when negotiating settlements.

It’s hard to overstate how significant this is. We campaigned hard and successfully achieved protections in the English higher education sector, and for victims of crime. However, if this amendment is successful, it will make the UK the WORLD LEADER in NDA legislation, and will extend protections to ALL workers in every sector.

To our huge excitement and pride, the amendment passed with full support in the Lords this Monday (14th July), with the campaign and Zelda’s work being kindly recognised by all who spoke.

Zelda was asked to meet with the Deputy Prime Minister and Justin Madders on Tuesday, who have shown their commitment to ensuring this bill passed through it’s next stages and that its intentions are held firm. They also discussed exploring whether the protections in the Victims and Prisoners Act can be applied retroactively, so that NDAs used to cover up past crimes can be voided.

So, what’s next?

The amendment will be debated in the House of Commons in early September and should hope to receive Royal Assent before the end of the year.

However, the most important stage will be consultation, where the regulations underpinning the new law will be developed over the next months. CBMS will be working with the Government policy team and hope to ensure the details of what “excepted” confidentiality in settlements would look like. We must now secure cast-iron guarantees on the details that will truly protect people:

• Ensuring confidentiality cannot be requested or suggested by the employer, but only at the request of the victim.

• Mandatory independent legal advice.

• A non-disparagement clause is included within the definition of an NDA and is subject to the same restrictions.

• Confidentiality should be of a limited duration, with option for victim to waive their own confidentiality if and when they desire.

• A clear list of “safe” people a victim can always talk to, including doctors, regulators, lawyers, and a trusted friend or family member.

CBMS legislative work 🎯

• Higher education wins - but workers still left behind

  At the start of the year, the landmark Higher Education (Freedom of Speech) Act - which bans NDAs in cases of sexual misconduct, discrimination and bullying in universities - was reinstated. This is the first law of its kind in England and came about from our voluntary pledge. However, while staff, students and visiting speakers are now protected, the wider UK workforce remains exposed.

  The Act will come into force on August 1st.
  

• New legal protections coming this October

  Section 17 of the Victims and Prisoners Act will make it illegal for NDAs to prevent someone from speaking up if the believe they are a victim of crime - including sexual harassment, assault, or discrimination. It protects your right to speak to a lawyer, doctor, regulator, support service, or close family member. This only applies to NDAs signed after that date, but it’s a major milestone. We’ve worked closely with the Ministry of Justice to help shape guidance and will continue to push for strong implementation.

  The Act will come into force on October 1st
  

• Parliament speaks, Labour listens

  Thanks to tireless work with our cross-party allies, we helped table a game-changing amendment to the Employment Rights Bill in March. Co-led by Louise Haigh and Layla Moran, it received over 45 cross-party co-signatures - the most of any amendment in the Bill and the only one with full cross-party support. They used parliamentary privilege to break NDAs on the record, exposing cases at ITN involving harassment and disability discrimination. While it was withdrawn, it showed Labour that this issue wasn’t going away, and the overwhelming support reinforced this.

• Political pressure is working (thanks to our brilliant allies)

  We’ve found a powerful new ally in the Commons: Louise Haigh MP. Since the start of the year she’s thrown her full weight behind NDA reform, rallying support across the aisles and helping keep the issue on the parliamentary agenda. In April, she led a Westminster Hall debate that drew broad cross-party backing. Days later, Layla Moran MP raised the issue directly with the Prime Minister during PMQs. Starmer’s response? “We will do whatever we can to make sure [NDAs] are not misused.”

• Peer pressure

  When the Employment Rights Bill arrived in the Lords, the call for NDA reform was loud, even during the Second Reading. We were supported by a formidable band of Baronesses: Helena Kennedy, Susan Kramer, Helena Morrissey and Frances O’Grady. Each spoke passionately as did many other peers and four NDA amendments were tabled launching a rousing cross-party charge within the Lords. At committee stage the Minister steering the Bill pledged that the Government wouldn’t argue that this “isn’t the right vehicle” for the reform and that they would amend the bill. A major win. Momentum is now building behind a single, consolidated amendment, whilst we wait to see what amendment the Government proposes. It better be good otherwise Labour will face a defeat in The Lords!

From packed parliamentary rooms to Europe’s biggest creative and legal stages, CBMS has been busy taking the campaign in all directions.

• February – CIISA Standards Launch

  We kicked off the year supporting the launch of the new CIISA standards, a landmark step toward creating safer work cultures in the creative industries. CBMS helped shape their NDA guidance, marking a huge moment for accountability in TV, film, and music. Read the full guidance here

• March – APPG on Modernising Employment

  Zelda spoke at Parliament’s APPG for Modernising Employment on International Women’s Day, joining other advocates in calling out the legal blind spot that allows NDAs to keep women silent. Her message? The Government isn’t ready, but society is.

• May – Petition Hand-In + Parliamentary Drop-In 📮

  At the start of April, we launched a petition with 38 Degrees and a snap poll with Organise.

  In a month, nearly 93,000 people had signed the petition, calling on the Government to stop NDAs covering up abuse, and over 2,000 workers had completed the survey, showing shockingly in a new report, how nearly 1 in 3 workers had signed an NDA, and over 1 in 4 know someone who had signed one. We hand-delivered the petition to Downing Street… and also met a very special resident.

After handing in the petition, CBMS and Louise Haigh MP, Layla Moran MP, and Lee Barron MP, hosted a buzzing Parliamentary drop-in for MPs and Peers, joined by singer and campaigner Rebecca Ferguson MBE. The session was well attended, and offered a rare chance for politicians to speak directly with legal experts, advocates, and people from many different sectors who’ve been harmed by NDAs. The energy in the room was undeniable - real stories, real urgency, and a clear message: this issue can’t be ignored any longer.

• June - Festival Season 🎤
  With a very busy start to the month, Zelda spoke at the inaugural European SXSW in London with a powerful conversation on “Is Whistleblowing Dead?” - alongside Psst.org founder Jennifer Gibson and Microsoft whistleblower Will Alpine. Uber whsitleblower, Mark MacGann was meant to be part of the panel but, due to his current position at Harvard, couldn’t risk leaving the U.S. as he was unlikely to be allowed back into the country due to Trumps sanctions on Harvard…

The next day, Zelda delivered two keynotes, firstly at Crafty Fest, Europe’s largest gathering for in-house legal counsel. Here she challenged legal professionals to rethink the role of NDAs, reminding them to use their hearts as well as heads when dealing with silencing victims. She then headed to Cambridge to speak to behavioral strategy firm Acteon, exploring how to “Speak to the Human” when it comes to risk, resilience, failure and doing the right thing.

MC’DONALDS
In January, the BBC revisited its investigation into sexual harassment claims at McDonald’s, and it was even worse than before. Hundreds of new complaints were files, and NDAs were reportedly used to silence staff.

FUJI TV
In February, it was revealed that an NDA was used to cover up a sexual misconduct case against a top Japanese TV presenter. The network continued to hire him despite knowing the allegations. When this was revealed, the top executives resigned.

Zelda was interviewed by Asahi Shimbun, a leading Japanese news outlet, as part of the growing discourse in Japan around accountability and speaking out. It’s inspiring to see the campaign reaching so far, and influencing discussions around NDAs.

THE COST OF SILENCE
Protect UK released a landmark report in March showing how ignoring whistleblowers in three major UK scandals (Post Office IT Horizon, Lucy Letby, Carillion collapse) has cost the taxpayer more than £426 million.

CHANNEL 4’s GAGGING PROBLEM
Despite branding itself a defender of free speech, Channel 4 was exposed this June in a Deadline article for using broad confidentiality and non-disparagement clauses in at least 61 settlement agreements between 2017 and 2021 - many involving allegations of discrimination, including pregnancy-related cases. Zelda, who has held multiple meetings with departing Channel 4 CEO Alex Mahon, calling on the broadcaster to ditch these clauses and sign the CBMS Pledge. While Channel 4 denies using NDAs “to cover up wrongdoing,” it has done neither of those things, and the reality is that their clauses function exactly like the NDAs our campaign is working to end. As Zelda put it: “Channel 4 is playing legal God with what former employees are allowed to say.”

• We have been snapping at the ankles of MPs as our high hopes for Labour action are tarnishing. Zelda has met with cross party allies and MP’s including Caroline Nokes (Deputy speaker), Layla Moran (Lib Dem), Baroness Harman (Labour), Jess Phillips (Under secretary of State for safeguarding & violence against women & girls) and Under secretary of State for Business Justin Madders. More coming shortly with Anneliese Dodds (Minister of State for Women and Equalities) and Bridget Phillipson (Secretary of State for Education) to make sure the Government upholds its promises.

• CBMS gave substantial evidence to the Employment Rights Bill Committee which is currently debating the reform of the Bill along with an amendment to restrict the use of NDAs. If this goes through our work is nearly done….fingers crossed.

• In August we learnt that you can never count your chickens…even once you have received Royal Assent.. The new Labour govt put the Higher Education (Freedom of Speech) Act on hold the day before it came into action. This means that our landmark amendment banning NDAs in HE is now ~in limbo~ however we choose to look at the positives of which there were two: The Government and Jess Phillips reached out to CBMS personally to promise that they would action this amendment elsewhere in legislation and secondly..

• In September the Office for Students officially regulated on NDA use in universities, banning them from being used in cases of harassment or sexual misconduct. This change empowers students across England to seek justice without being silenced and protects the action the halted legislation would have created. The OfS will still be promoting the CBMS pledge which covers staff too and it is essential that the universities that are yet to sign the pledge still do.

• In October the Worker Protection Act (2024) came into force. This important amendment to the Equality Act places an active duty on employers to prevent sexual harassment in the workplace, including from third parties, marking a significant advance in safeguarding employee rights. The EHRC will be auditing companies on this so if your organisation wants to show its proactivity, make sure you’ve signed up to our business pledge and be ahead of the game.

• In Ireland, Senator Lynn Ruane’s amendment to the Employment Equality Act passed the Seanad in October and was signed into law by President Micheal D Higgins. Under this Bill, provisions to all but ban the use of NDAs have been enacted, victims of workplace abuse, harassment and discrimination will still be able to have confidentiality in a settlement, so long as the agreement is made at their request and meets certain other conditions. This is the FIRST law of its kind in Europe and we are so proud to have been part of this.

• This autumn the governing body of the Trade Unions Congress voted in the motion that “All unions must ensure the use of NDAs or settlement agreements is in line with TUC and Acas best practice guidance. They must not be misused in cases of sexual harassment, or any other form of bullying, harassment, or discrimination, or as an alternative to carrying out robust investigations”. This is a massive step for unions throughout the country and means that all affiliated unions must uphold this action. This is mostly due to the amazing work of CBMS ally Nikki Pound, TUC Women's Policy Officer, #MeTU and the This Is Not Working Alliance through which we have been working hard to improve the standard of trade unions and their treatment of women.

Out & About Advocacy 🪂

  DWF Group roundtable: Zelda partnered with Tracey Groves, Kate Meadowcroft, and Nicki Eyre for an enlightening workshop, where they examined the new sexual harassment duties on businesses by the Workers Protection Act and considered with the attending heads of HR and Legal services how businesses can step up to meet these challenges.

• Manchester 📍
  Beyond The Music: Zelda joined inspiring advocates, including Jen Smith, Ni Maxine, Frances Barber Shillito, and Dr. Diljeet Bhachu, at this dynamic festival to highlight how NDAs are preventing the music industry truly becoming a safer place for women. This event was one of the first proper introductions for the Creative Industries Independent Standards Authority (CIISA) who CBMS have been consulting for since the beginning of their formation. CIISA aims to improve standards of behaviour across the creative industries and to prevent and tackle all forms of bullying and harassment.

• Dublin

  IBA Global Professional Ethics Symposium. It was a great opportunity to speak at the International Bar Associations event. The panel discussed "Zealous v abusive lawyering: where is the fine line between doing ‘the best for the client’ and abusing the weaker party?" and it was good to ask some hard questions…

• Munich 📍
  European Compliance & Ethics Conference: Zelda addressed compliance professionals in Munich, discussing ethical approaches to NDAs and the atmosphere of learning, improvement and sharing information filled us with optimism for the changes that are creating better working environments.

• Online 💻
  LINEE Conference: hosted by Keystone Law, Zelda shared insights alongside an esteemed panel of international lawyers on the ethics of abusive NDAs and what responsibility lawyers play in these deals. There were great examples of how legislation abroad is actually effecting things. A notable example was that in California where NDAs are off the table in cases of sexual harassment, this has actually improved negotiations and there is no issue about confidentiality being linked to payment. This supports our data which show that settlement agreements have increased by 9% in states banning NDAs going against lawyers belief that removing confidentiality would chill settlements.   Awards!

• Woman of Influence Award: It was a huge honour for Zelda and her work to be recognised amongst so many other incredible group of women. Thank you to Baroness Sandy Verma and a big congratulations to Zelda’s fellow awardees, Emma Pinchbeck FEI, Fatima Whitbread, Rachel Baker, Nicola Careem, Leila McKenzie-Delis, Michelle T. Davies (née Thomas), Radhika Nayar, and Aaliya Sekatawa.

• Whistleblower Champion Award : A big thank you to Whistleblowers UK for awarding Zelda this year. WBUK have been great allies to CBMS since day one and have worked our NDA policy into their whistleblowing bill.

NDA misuse still rife…

Since June we’ve continued to see revelations surface surrounding abuse, discrimination and mistreatment from around the globe - whether from P.Diddy to the Church of England what do all these stories have in common?…..NDAs.

Neil Gaiman’s alleged abuse:

Over the summer Tortoise Media broke the story on acclaimed author Neil Gaiman, with the help of CBMS. Speaking first to two women, and eventually to five in total, who alleged sexual misconduct by Gaiman. Underpinning the stories of abuse and manipulation, a recurrent theme was the NDAs Gaiman used to silence these women and stop anyone from connecting the dots.

Mohamed Al-Fayed’s victims finally listened to:

In September it was revealed that the late Mohamed Al-Fayed used NDAs to shield allegations of harassment and misconduct for years. Fayed’s actions highlight yet again the systemic corruption which allows powerful individuals to exploit NDAs to evade accountability, silence victims and perpetuate cultures of fear. Fayed covered up his sexual abuse by intimidating victims into signing NDAs as well as taking libel action against media outlets that tried to expose him.

Zelda appeared on several news outlets and here on Newsnight alongside Harriet Harman to discuss the need for legislative reform to prevent these abusive systems…

ITN’s damning report on internal complaints:

In October an investigation into ITN precipitated by many of the brave victims we are working with revealed the systemic failings in addressing workplace harassment and discrimination. ITN creates the news for Channel 4, Channel 5 and ITV and the report uncovered that there were serious material failures at ITN and NDAs were used regularly and inappropriately with employees to settle internal complaints, fostering a culture of silence. Daisy Ayliffe was one of the first people to bravely speak up about this last year and it’s because of the bravery of individuals that organisations are being called to account. We wait with baited breath to see what the outcome of this report will be…

New partners and team mates🙋

• We were utterly flabbergasted by an anonymous donation to the campaign specifically to fund emotional and psychological support for victims who come to CBMS weekly - this enabled us to partner up with Dr Naomi Murphy and Octopus Psychology which has been life changing for the victims of NDAs and for all of us who have felt ill equipped to deal with the deep trauma and psychological damage that NDAs create in the people we speak to.

• Closer to home, Oscar Bannock Priest has joined the team, supporting Zelda directly in the UK. She now has four hands instead of two so presumably our success rate will double….(no pressure Oscar)

In the UK it is crunch time as the Employment Rights Bill, recently introduced by Labour, is debated. We have had a steady stream of achievements with both UK legislation and law sector changes this year. Rather inconveniently though the break in parliament means that all petitions have been closed down, including ours which we launched last month with Pregnant then Screwed. 🐎 More law passed!🐎

We are pleased to report another victory with legislation in the form of the recently amended Victims and Prisoners Bill. This amendment will ensure that NDAs are void if concealing criminal conduct and that they cannot prevent victims from accessing legal, regulatory, therapeutic or other advice related to criminal conduct. We believe this clarification will empower victims, ensuring they have the freedom to seek justice and support without the fear of being silenced by NDAs.

This amendment marks the second piece of law changed in regard to NDAs - not bad after only two years of campaigning!

Was Government listening? 📣📣

The evidence CBMS gave to select committee inquiries last year was heavily cited in their reports this year with the Women and Equalities Select Committee releasing a concerning report on their inquiry into misogyny within the music industry. ‘Misogyny in Music’ found a distressing amount of NDA misuse, often employed to silence victims of harassment and discrimination. The committee called for a ‘retrospective moratorium of NDAs,’ a groundbreaking recommendation that seeks to nullify previously signed NDAs that have been used to conceal misconduct. Following on from this the Treasury Select Committee’s parliamentary inquiry,’ Sexism in the City,’ which investigated the prevalence of sexism within the financial sector, also revealed a shocking misuse of NDAs to cover up incidents of discrimination and harassment and also recommended a complete ban on NDAs.

It is therefore incredibly disappointing that despite the findings the Government refused to ban non-disclosure agreements in all harassment cases. There have now been FOUR select committee reports and one Government department consultation recommending root and branch change in legislation on NDAs, so why has the conservative government allowed these power imbalances to stay in place?

Law sector creeping forward… 📄

In February, the Legal Services Board published their summary report commenting on the alarming evidence of the misuse of NDAs. We are waiting with bated breath as to what action they will take. This could lead to a statutory policy change making it an offence for solicitors to use NDAs to conceal any form of harm which would essentially solve the issue and is our ultimate goal.

We are also happy to say that the Bar Council has publicly supported the need for legislative reform concerning NDAs. In a recent public statement, they declared that “NDAs are ripe for legislative change” and expressed their approval of any government’s intent to implement these necessary reforms. This endorsement from the Bar Council underscores the legal community's recognition of the urgent need to address the misuse of NDAs and we are grateful for the open dialogue we have had in these discussions.

CBMS take to the Royal Courts of Justice ⚖️

On the 14th of May over 100 of us stood, gagged, outside the royal courts of justice to represent the women who have signed abusive NDAs.

We protested in collaboration with Pregnant then Screwed, whose most recent survey showed that 435,293 mothers in the UK have been silenced by an NDA or confidentiality clause following harassment, discrimination or bullying at work. The new data also reveals the devastating and lasting impact that NDA’s and confidentiality clauses have on mothers’ lives, with three-quarters of mothers who have signed one reporting mental health deterioration as a result.

Across the pond 🇨🇦

In May Zelda joined co-founder Julie Macfarlane for a cross-Canada tour to meet with senators, ministers, and members of Parliament in Ottawa, as well as members of the Legislative Assembly in British Columbia. The tour included a press conference in Ottawa with Senators Marilou McPhedran and Kim Pate, an introduction to the Canadian Senate, an introduction to the Legislative Assembly in British Columbia and another press conference with BC Green Party Leader Sonia Furstenau.

The last few months CBMS have been working with Marina Wheeler KC and Emily Thornberry on Labour's Green Paper investigating how to improve womens experience in the workplace, focusing on misconduct and whistleblowing. It’s been a non-stop couple of months. Despite cancelled flights, delayed trains, unforgiving fog, and a whole host of logistical challenges, we’ve been on the move to contribute to research, talk to those in power, and oh, maybe change some more law..

First up…

Two years ago, Can’t Buy My Silence collaborated on drafting a “model bill”, which was first introduced in Ireland by Senator Lynn Ruane.

This bill has acted as a template for the successful PEI Canadian bill and as inspiration for England and Australia. It prohibits the use of NDAs in instances of abuse and harassment in the workplace and puts the power into the hands of the victims who have the CHOICE about how and where confidentiality is used but draws the line under confidentiality about any harmful behaviour.

On the 25th of October the model bill; Employment Equality (Amendment) Bill 2021 successfully completed its final stage in the Seanad with government and total cross party support. Legislation is a cornerstone of the change we hope to achieve at CBMS, and we are at the final stage of a groundbreaking change in the law that will protect the entire economic workforce in Republic of Ireland from the misuse of NDAs.

This year we have had great success passing the first law of its kind in the UK banning the use of NDAs in Higher Education, and with provincial law in Canada, but the Irish Bill will be the first time a country fully legislates to outlaw NDAs that attempt to hide abuse. The Bill heads to the Dáil where it will be become legislation. Hopefully this will be done in the next 18 months. THANK YOU and congratulations to the phenomenal Senator Lynn Ruane and Ireland for leading the way.

Next on the legislative agenda…🤝

After resounding cross party support to broaden protections from NDAs to the wider workforce was heard in the September Westminster hall debate, ministers were keen to meet with us to discuss our Business Pledge and how legislation can be improved. We have had extremely positive meetings with the Undersecretary of State for Business and Trade, Kevin Hollinrake and the Shadow Minister for Business and Trade, Justin Madders who have the keys (or potentially do) to amending the Employment Act. We also met with the shadow Attorney General, Emily Thornberry alongside Marina Wheeler KC who has been employed by Labour to advise on improving employee protections, particularly for women. Our allies in Labour are working hard to make sure that this issue is in their manifesto while our Conservative and Lib Dem allies are also doing sterling work keeping the issue on the agenda.

Earlier this year we also collaborated with Dame Maria Miller MP on an amendment to the Victims and Prisoners Bill which would expand the definition of 'victim' to include people who have signed NDAs designed to cover up misconduct. This has passed through all its stages in the Commons and is now at second reading in the Lords. Although this won’t solve the problem it will create a layer of protection for those who have been gagged.

…and the regulatory agenda ⚖️

The LSB (oversight regulator of all legal services in the UK) call for evidence came back with compelling proof that NDAs are being used where they shouldn’t (!!) We wait to see how they plan to act on this information as the SRA also published a report into the the use of NDAs and admitted this was an area of concern. Also, after a bit of tennis in the legal press with the Bar Council, we have had a positive meeting with the president and some of the board who agreed to work with CBMS on a letter from the Bar to ministers supporting NDA legislative change.

The Business Pledge.. ✒️

We have had some inspiring and challenging times with the pledge in our build up to launch. In early September Zelda attended the The Responsible 100 Forum organised by the Rothschild Foundation and Tortoise media at Waddesdon where she had the opportunity to speak about the aims of the pledge and campaign to the full conference of non executive directors and board members from the leading top 100 FTSE companies. It was a stellar business crowd but CBMS made its mark and created an exceedingly lively debate. The pledge is now being discussed in board rooms across the globe and CBMS are in negotiations with many of the firms they met there. This was an incredible opportunity and we want to thank James Harding founder of Tortoise media for making this possible.

Meanwhile in the wake of Daisy Ayliffe breaking her two ITN/CH4 NDAs and the Russell Brand scandal, we met with the CEO’s of CH4, ITN and ITV to offer them the chance to lead the way by stopping the use NDAs to gag their employees. The talks were all positive but we are yet to have any signatures…however we are sure the new year will bring new fountain pens to the table. Meanwhile our talks continue with Oxfam, TSB, NatWest, Google and more as we gather our launch signatories to the pledge.

Also (nearly there…)🎥🎞️

This year we gave evidence to three vital Select Committee enquiries - The Treasury Select Committee on Sexism in the City, the Women and Equalities Select Committee on NDAs in the music industry, and the Justice Select Committee on the regulation of legal professions. We are very glad to see these issues being taken seriously and grateful for the chance to add our voice to crucial discussions. As can be seen already from the results of the evidence from the Sexism in the city enquiry that misconduct and NDAs are rife.

We also contributed to the report  Safe to Speak Up? Sexual harassment in the UK film and television industry since #MeToo. The report, by Dr Anna Bull founder of the 1752 Group, looks at the UK film and TV industries. It reveals that nearly six years on from the 2017 #MeToo movement, the industry is not fulfilling its legal obligations around preventing and responding to sexual harassment in the workplace and NDAs are endemic. Although there have been many positive changes too, this report shows the essential need for CIISA the new creative industries independent standards authority. We are collaborating with CIISA, and fully support, CEO Jennifer Smith and Dame Heather Rabbatts (Times UP UK) as they move towards full operation.

Let’s not forget… 📣

Those brilliant women who have broken their NDAs and spoken up this year - their decision to do so has laid bare the changing environment and the reality that many NDAs are unenforceable, immoral and tools of abuse that are no longer working to protect the reputations of those who use them….

It’s been a hectic few months with so much happening that we haven’t had time to update you. Here are some of our biggest stories and the pretty incredible news that we have CHANGED THE LAW (well some of it).

CBMS Pledges making legislative change

You may remember in 2022 we launched a voluntary pledge for Universities and colleges to sign agreeing to no longer use NDAs inappropriately. The pledge was backed by the Department for Education and in February this year an amendment to the Higher Education (Freedom of Speech) Act was passed which prohibits the use of NDAs in cases of sexual misconduct, harassment, bullying and discrimination. The Bill received Royal Assent in record time this May and means millions of students and thousands of staff are now protected from abusive NDAs. This is the FIRST LAW OF ITS KIND IN THE UK prohibiting the use of NDA’s to cover up abuse.

We are now mirroring this initiative with our Business Pledge, asking businesses from all sectors across the country to sign up. This pledge was discussed in a Westminster Hall Debate on NDA’s, where unified cross party MP's demanded that the Government broaden the protections afforded to higher education to all of the economic workforce. CBMS is meeting with Kevin Hollinrake, the Under Secretary for Business and Trade, this month to discuss the department’s support.

The pledge will be officially launched in the coming months with the first signatories from each sector being leading lights in responsible business and employee relations. Regulatory change in the pipeline

Earlier this year the Legal Services Board launched a call for evidence into the conduct of legal professionals involved in creating NDAs. This came about after CBMS took part in their roundtable and conference. The LSB would like to make a Statutory Statement of Policy that would make it an offence for lawyers to draw up NDAs that concealed any form of misconduct. If this happened it would be a major success for our campaign so we will be following developments closely.

After a series of exchanges in Legal Futures between CBMS and the Bar Council, the chair of the latter, Nick Vineall KC, told Legal Futures: “The Bar Council agrees with Dr Julie Macfarlane and Zelda Perkins that the law on NDAs should be reviewed and that there is an important debate to be had about the circumstances in which NDAs may be lawfully used”. CBMS is meeting with the Bar Council in November to discuss this further.

Breaking NDA cases

Over the summer two high profile men, Crispin Odey and Sir David Adjaye were exposed as a direct result of individuals breaking their NDAs and sharing their experiences. Last year an investigation into TSSA also uncovered years of abusive behaviour after Claire Laycock bravely broke her NDA.

Last month Daisy Ayliffe broke her NDAs with Channel4/ITN, just a week before the Russell Brand revelations that had many questioning why such stories took so long to surface. In light of these recent developments the heads of ITN, CH4 and ITV have agreed to meet with CBMS. Watch this space…..

Funding at last!

CBMS UK were incredibly honoured to be approached by two separate funding bodies this year and more incredibly were awarded funds by them both. We also received a substantial personal donation all of which has meant Can’t by My Silence can afford its first official UK team member, transforming how we work.

We would like to profoundly thank The Joseph Rowntree Reform Trust and Caryn Mandabach who have provided the campaign with significant funding so that this important work can be stepped up a gear.

As a result the amazing Caitlín Sim has come onboard as our Campaign & Communication Manager. Caitlín has direct experience in campaigning with her own not-for-profit which raised awareness of harassment on public transport and resulted in Transport for London’s poster campaign and the Railway Guardian app.

CBMS UK are also now part of the Breakthrough Accelerator 2023 program. Breakthrough support campaigns led by people with direct experience of issues to ensure their campaign has the impact intended. They will be supporting us with strategy and more as we work together to ban the misuse of NDAs.
